Public inquiry representation
Public inquiries can
be held by the Traffic Commissioner for a variety
of reasons, the most common reasons are to hear
objections to the granting of an Operators Licence
or the continuation of a licence and also where an
offence may have been committed or a breach of
good practice brought to light by a roadside
inspection or a visit to your Operating centre.
Public Inquiries are
held in a formal court setting and the Traffic
Commissioner will want to see a commitment to the
improvement of the running of your licence and the
systems in place to affect this.
The Traffic
Commissioner has many penalties available to him
or her where an objection is upheld or where it is
established an offence has occurred.
These penalties range
from a reduction of size of fleet allowed on the
Operators Licence to fully revoking the licence.
In the case of objections to a Licence being
granted undertakings may be added to the licence
restricting for example the hours the Operating
centre may be in use, such as bank holidays
weekends and early mornings.
